RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT (the “Release Agreement”)

BY SIGNING THIS DOCUMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT FOR YOURSELF, HEIRS, OR NEXT OF KIN.

PARENT/GUARDIANS: SEE CONSENT AND INDEMNITY FOR MINOR PARTICIPANTS (under 19) AT THE END OF THIS AGREEMENT.

To Beaver Canoe Club: its board, officers, member clubs, employees, instructors, leaders, guides, volunteers, representatives, contractors, subcontractors, suppliers, private property owners who have allowed access to their land, provincial, territorial, municipal or regional parks, recreation sites, sponsors, agents and His Majesty the King in the Right of the Province of British Columbia (all hereinafter referred to as “the Releasees”).

DEFINITION OF PADDLING AND WILDERNESS ACTIVITIES
In this Release Agreement, the term “Paddling and Wilderness Activities” shall include but is not limited to: canoeing, kayaking, paddling, camping, hiking, portaging, scouting, and all activities, events or services provided, organized, or authorized by the Releasees including, but is not limited to: whitewater, lakewater, river and ocean paddling; rental or use of canoes, kayaks, and other paddlecraft (hereinafter “boats”) and other equipment; instructional sessions, courses, clinics, or club trips; and all travel, accommodation, food, beverage, and water supply; transport and all accommodation including camping.

NON-SCHEDULED OR EMERGENCY EVACUATION, RESCUE OR FIRST AID
I acknowledge and agree that all expenses associated with non-scheduled or emergency evacuation, rescue or first aid will be my responsibility and will not be covered by the Releasees. (Initial in Box 1 below.)

ASSUMPTION OF RISKS
I am aware that the Paddling and Wilderness Activities involve many risks, dangers and hazards including, but not limited to: accidents during transportation or travel; slips and falls; overturning of the boats; accidents while carrying of boats; loss of balance; impact or collisions, rapids and currents; entrapment by trees, logs, boats or equipment; drowning; hypothermia; changing and inclement weather conditions including storms, high wind, waves, and lightning; encounters with wild animals and biting insects; negligence on the part of other participants; equipment failure; and negligence of other boaters.

I ASSUME THESE RISKS, AND I AM AWARE THAT THERE IS ALSO A RISK OF NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN PADDLING AND WILDERNESS ACTIVITIES. (Initial in Box 2 below.)

AGREEMENT
In consideration of the Releasees agreeing to my participation and permitting my use of their services, equipment and other facilities, I HEREBY AGREE AS FOLLOWS:

  1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the releasees; and to RELEASE THE RELEASEES from any and all liability for loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer as a result of my participation in the Paddling and Wilderness Activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, breach of contract, or breach of any statutory or duty of care, including any duty of care owed under the Occupiers Liability Act, on the part of The Releasees. Negligence includes the failure on the part of the releasees to safeguard or protect me from the risks, dangers and hazards of participating in Paddling and Wilderness Activities.
  2. To hold harmless and indemnify the releasees for any and all liability for property damage, loss or personal injury to any third party resulting from my participation in the Paddling and Wilderness Activities;
  3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;
  4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the province or territories where the Paddling and Wilderness Activities take place and no other jurisdiction;
  5. Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of British Columbia and shall be within its exclusive jurisdiction;
  6. In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of participating in the Paddling and Wilderness Activities, other than what is set forth in this Release Agreement.

PARENT/GUARDIAN CONSENT AND INDEMNITY FOR MINOR PARTICIPANTS (under 19)
By signing below I confirm that I have the authority to consent to the above named minor’s participation in the Paddling and Wilderness Activities. I have read and understood this Release Agreement and I consent to the minor’s participation in these activities. I acknowledge and accept, on behalf of the minor, the risks, dangers and hazards associated with such activities. I agree to indemnify and hold harmless the Releasees from any and all claims, demands, damages, costs or expenses that may arise out of or in connection with the minor’s participation in the Paddling and Wilderness Activities, including any claims brought by or on behalf of the minor. I understand that I am not waiving the minor’s legal rights, but I am agreeing to this indemnity in consideration for the minor being permitted to participate.

  2. By renewing, you agree to the waiver, please read it carefully.
  3. Once you are logged in click on the “renew membership” button below to complete payment through Paypal.
  4. Please review and edit your personal details in your membership profile and update them, including your emergency contact details, and remember to click SAVE at the bottom.
